The use and sale of electronic nebulizers is legal in Moldova. Electronic atomizers containing nicotine are regulated by Tobacco Control Law No. 278 (with amendments) and fall under the category of “related products – products made from smoking plants and products containing nicotine”. Although Moldova is not in the EU, these regulations are similar in many respects to the EU Tobacco Products Directive (TPD) (2014). Advertising, promotion, and sponsorship of e-nebulized products are prohibited in Moldova, as are cross-border remote sales, Internet sales, and street vendor sales; retail outlets are restricted in proximity to educational and medical institutions.

 

Basic requirements

 

Electro-atomized products containing nicotine and refill containers that are not issued as pharmaceutical or medicinal products may be placed on the market if they meet the following prerequisites.

 

1. the nicotine content in the liquid of the e-atomizer and refill container does not exceed 20 mg/ml

 

2. the nicotine content of the e-atomizer and refill container does not exceed 2 mg/unit

 

3. the maximum capacity of the cartridges and canisters of disposable electronic cigarettes or disposable cartridges does not exceed 2 ml

 

4. the maximum volume of the refill container does not exceed 10 mL

 

5. The following additives are prohibited by law in electronic atomizers and refill containers.

 

(a) Vitamins or other additives that create the impression of a health benefit or low health risk

 

(b) Caffeine, taurine and other additives and stimulant compounds related to energy and vitality

 

(c) Additives with coloring properties for emissions

 

(d) additives that promote inhalation or nicotine absorption (suggested reference to the Latvian list, menthol category)

 

(e) Additives that increase toxicity, or addictive or carcinogenic, mutagenic or proliferative toxicity

 

Warnings/packaging requirements

 

1. The packaging must contain a warning

 

2. Warnings

 

   a. Health warnings should be printed in colorfast ink, with the first letter of the statement capitalized and other lowercase.

 

  b. Text “Acest produs conţine nicotină. Nicotina generează un grad sporit de dependenţă”

 

     This product contains nicotine, which is a highly addictive substance.” (official language)

 

   c. printed on the two largest faces (i.e. front and back) of the unit packaging and any outer packaging

 

   d. Cover not less than 30% of the exterior surface area of the unit package and the corresponding face of any overpack, without commentary, explanation or other text or illustration of the warning statement

 

   e. The warnings must be clearly visible and complete so that they are not separated, erased or hidden or covered or interrupted by any other information, including inscriptions or illustrations or tax labels, and that the warnings remain intact when the package is opened.

 

   f. The warning is printed in bold black Helvetica letters on a white background, with the letters occupying the maximum surface area reserved for text

 

   g. Be framed by a black border no less than 3 mm wide and no greater than 4 mm wide

 

   h. The text must be focused and parallel to the side edges of the unit pack and outer packaging

 

    i. Prohibit the printing of warnings on the tax label

 

    j. Prohibit “lipstick test” packaging or packaging associated with food or cosmetics or toys

 

    k. Prohibit the use of packaging other than the manufacturer’s original packaging or damaged packaging

 

 

 

Registration

 

Manufacturers and importers must notify the National Institute of Public Health of any relevant products they intend to place on the market. The notification must be given at least 90 days before the product is placed on the market and must include

 

(a) a detailed product description

 

(b) Information on ingredients and emissions

 

     A list of all ingredients and their amounts used in the manufacturing process for all brands and product types, as well as the level of emissions. The list should be accompanied by an explanation of the reasons for the addition of such ingredients to the tobacco product in question, and a description of the function and type of ingredient. The list is arranged in descending order of the weight of each ingredient contained in the product.

 

(c) Existing studies on the toxicity, addictive potential, and attractiveness of the product, particularly with respect to ingredients and emissions

 

(d) Existing studies and market research on the preferences of various consumer groups, including young people

 

Age restrictions

 

Sales to minors under the age of 18 are prohibited and this information must be clearly displayed. Age verification is required at the point of sale.

 

 

Other

 

Advertising, promotion and sponsorship are prohibited.

 

Cross-border remote sales (sales via the Internet), sales through street vendors, temporary stalls and counters, and commercial vending machines are prohibited.

 

The sale of the following tobacco products and related products is prohibited: No certificate of origin from the manufacturer or seller to ensure their traceability.
